For the purposes of this agreement, "you" means the parent or guardian, as well as the student who is using the website or service.

Elements of this website are protected by trademark and other laws, and this website and its contents may not be copied or imitated in any way without the express written consent of Swell Financial Services Pvt Ltd.

Parents and Legal guardians are deemed to have communicated their consent with their name appearing on the student information sheet available at the Website. Unless otherwise specified, the content on the PtutoR Web site is for your personal and non-commercial use and we grant you a limited license to access the PtutoR Website for that purpose. You may not download, modify copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the PtutoR Website except with our written and express consent. Any unauthorized use of the PtutoR Website or its contents will terminate the limited license granted by us.

We shall have no liability to you for any interruption or delay in access to the Website irrespective of the cause. We cannot promise that access to the Website will be uninterrupted or error free. We reserve the right to suspend access to the Website during the scheduled maintenance windows. There may also be occasions when access to the Website is interrupted for emergency maintenance or repairs or to carry out upgrades to improve the performance or functionality of the Website. Access may also be interrupted due to failures of telecommunications links and equipment, which are beyond the control of PtutoR.

You accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability. You also acknowledge that we cannot be held responsible for any delay or disruptions that are inherent in the operation of the Internet and the World Wide Web, including viruses and other malware.

We shall not be liable to you for any loss or damage whatsoever arising out of or in connection with your use of the Website or any or content and/or facilities provided via the Website.

PtutoR reserves liberty to reschedule a session for any reason whatsoever, and including but not limited to power outage, connectivity problems, broadband failure, system shutdown, sound card failure, problems based on the tutoring platform, travel by tutor or student, ill health of tutor or student, vacations etc. For any of the above reasons, classes will be rescheduled to the maximum count of 3 times a month. An advance notice of at least 24 hours needs to be provided to tutor or student as the case may be. Exceptions will be made in the case of sickness or power shutdown when notice needs to be given at least an hour in advance.

Scheduling of tutoring sessions will be displayed on the Website and will be deemed to be the complete communication to the student.

You will not be liable to pay for a validly rescheduled session, however if the tutor has not been informed and has waited for the student at the appointed time beyond 15 minutes, then you forfeit the session and are bound to pay for the same.

PtutoR respects and understands the need and the importance of privacy and security for our students and other visitors to the Website. Any personal information maintained by PtutoR, including contact information, unique identifier information, transactional and financial information, is used only to contact such student or visitor for marketing and operational purposes.

Persons who provide us their telephone numbers or e-mail addresses on our website may receive telephone or e-mail contact from us with information regarding special promotions, new products and services or upcoming events.

If at any point you no longer wish to receive information from PtutoR, you can e-mail us at satyaperi@ptutor.net and we will remove you from our contact lists. PtutoR will not release, sell, rent, or trade personal information of any of our students to any third party.

This Website reserves the right to charge subscription and / or membership fees in respect of any part, aspect of this Website upon reasonable prior notice.

If any provision of these Terms becomes void or otherwise unenforceable in whole or in part, the validity of the remainder of these Terms shall not be affected.

Swell Financial Services Pvt Ltd reserves the right, to change these Terms at our sole and absolute discretion from time to time, without notice to you. The most current version of the Terms and Conditions will supersede all previous versions.

We reserve the right to withdraw all or part of the Website at any time. We also reserve the right to terminate this agreement and terms and conditions of use at any point of time.

The Agreement shall be governed by the Laws of the State of Andhra Pradesh, India. The Courts of law at Hyderabad shall have exclusive jurisdiction over any disputes arising under this agreement.

• These Terms of Service constitute the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.
